General terms and conditions

Article 1 - Definitions

In these terms and conditions, the following definitions apply:

Bon Bini Management:
the company that provides property management on behalf of home owners in Curaçao.
Client: the natural or legal person who uses the services
by Bon Bini Beheer.
Management: carrying out services such as guest contact, key handover,
cleaning planning, quality control, minor maintenance and communication with
booking platforms.
Services: all activities offered by Bon Bini Beheer as described in this
conditions.
Third parties: external parties such as cleaners, technicians, laundromats or photographers who
deployed by or on behalf of Bon Bini Beheer.

Article 2 - Applicability

These terms and conditions apply to all services that Bon Bini Beheer.
executes regardless of whether a written agreement has been concluded. By using
of our services, the client automatically agrees to this general
conditions.

Article 3 - Services

Bon Bini Beheer provides, among other things:

  • Guest communication before and during the stay
  • Check-in and check-out services
  • Cleaning planning and quality control
  • Laundry handling
  • Ad Management and Pricing Strategy
  • Minor repairs and inspections
  • Advice on rentals and home presentation

The exact activities may vary per home and are agreed orally or in writing with the client.

Article 4 - Rates and payment
  • All rates are discussed in advance and include taxes unless stated otherwise.
  • Payment must be made within 7 days of the invoice date.
  • Bon Bini Beheer reserves the right to suspend or terminate work in the event of non-payment.
  • Collection costs and statutory interest are charged in case of late payment.
  • Bon Bini Beheer reserves the right to adjust its rates periodically based on market developments, inflation, increased costs or changed circumstances.
  • Rate changes will be communicated to the client in a timely manner and in writing (by e-mail or WhatsApp is sufficient).
  • If a client does not agree to a rate change, the client has the right to terminate the cooperation subject to the usual notice period. If the cooperation continues, the client is deemed to agree to the adjusted rates.
Article 5 - Termination
  • The client can terminate the cooperation with Bon Bini Beheer at any time without notice.
  • We appreciate it if cancellation is notified at least 1 month in advance, so that we can properly coordinate the transfer and complete scheduled services in time.
  • Bon Bini Beheer strives for long-term collaborations and continuity in management.
  • Bon Bini Beheer can terminate the cooperation immediately in the event of repeated non-payment, deception or unworkable cooperation.
Article 6 - Access to the home

The client grants Bon Bini Beheer access to the home to carry out management tasks. In doing so, we work carefully and professionally, and limit access to what is necessary.

Article 7 - Key Management

Bon Bini Beheer ensures safe storage and transfer of keys. In the event of loss or damage, the client will be informed immediately. Any costs for replacing locks are borne by the client, unless there is proven negligence by Bon Bini Beheer.

Article 8 - Swimming pool management
  • If Bon Bini Beheer (or a third party on our behalf) manages the swimming pool,
    this includes: monitoring the water quality, refilling if necessary, adding
    chemicals and general cleaning of the pool surface.
  • Bon Bini Beheer is not liable for damage or accidents as a result of
    misuse of the pool by guests or third parties.
  • The client remains responsible for the general condition and technical
    swimming pool installations (such as pumps and filters), unless explicitly stated otherwise
    agreed.
  • If there are technical defects, extreme contamination or extraordinary
    circumstances, additional fees may be charged. This happens
    always in consultation with the client.
Article 9 - Liability
  • Bon Bini Beheer is not liable for direct or indirect damage to the home
    or household effects, unless there is intent or gross negligence.
  • We are not liable for damage caused by guests, third parties or force majeure
    (such as storms, leaks, blackouts, etc.).
  • Any damage found will be reported to the client. Bon Bini Management can
    provide support with processing, but is not responsible for reimbursement
    or claim of damage.
  • The client is fully responsible for concluding appropriate
    insurance for the home, contents and liability towards third parties.
Article 10 - Force majeure

In situations of force majeure (such as natural disasters, political unrest or technical failures)
Bon Bini Beheer can suspend or terminate its activities without
liability for damages.

Article 11 - Privacy

Personal data of clients and guests is only used for
execution of our services. Bon Bini Beheer does not share this information with third parties, unless
necessary or required by law.

Article 12 - Disputes and applicable law

These terms and conditions are governed by the law of Curaçao. Disputes are brought to
preference resolved in consultation. If necessary, disputes will be submitted to the competent
judge in Curaçao.
